As foreigners can not practise law, and giving more than general advice is considered practicing law in Thailand, we have our own in house Thai lawyer who is able to take care of property transactions and transfers for you. Alternatively we can recommend a number of bona fide firms in Pattaya. We do not push our clients towards a particular company they may not feel comfortable with.
Foreigners CAN own property in Thailand. However it may not be as straight forward as back in your home country, just as there may be special rules in your country for foreign buyers.
Currently foreigners can not own land in Thailand. This can cause some misunderstanding and confusion in the ex-pat community but there are a number of ways this can be legally overcome. So what to do? What you DON'T do is put your property in the name of your Thai lover — do this and you risk kissing your investment goodbye.
You can certainly (as the writer has) put the property in your partners name but attach a loan agreement or lease back agreement to the Chanod (title deed). Once that is done and registered at the land office your investment is secure.
Some developers now offer 30 year leases on new homes.
